New York Grand Larceny

In New York, the Office of the District Attorney has committed their efforts to address this kind of theft. There are four types of Grand Larceny charges, ranging from 1st degree to 4th degree. Grand Larceny in the 4th degree involves the theft of an item valued at over $1,000., but not to exceed $2,999.99. Grand Larceny in the 4th degree also covers thefts of a firearm, car (worth more than $100.), stealing a public record, or an item of religious worship. It is considered an E felony.

Grand Larceny in the 3d degree deals with stolen items valued at $3,000. or more, but not exceeding $49,999.99, and is considered a D felony. Grand Larceny in the 2d degree involves theft of an item of $50,000, but not exceeding $999,999.99. This crime is a C Felony. Lastly, Grand Larceny in the 1st degree deals with an item that is valued at over 1 million dollars or more.

A New York Grand Larceny Lawyer can tell you that often people do not realize that this charge can be based on an accumulation of items. For example, if a defendant takes $1,000. from a victim’s ATM, and does this 50 times over a period of 50 days, they can be charged with Grand Larceny in the 2d degree. This is not the case with other crimes such as burglary. If a defendant breaks into a victim’s home 50 times in 50 days, the defendant would be charged with 50 counts of burglary. If you have been accused of committing Grand Larceny, it is important to be aware of this distinction because it gives the District Attorney a large degree of discretion on how they will handle the case.

If you have been charged with Grand Larceny, it is likely that your New York Criminal Lawyer will try to work out a plea bargain with the District Attorney. The issue of restitution is important here. The District Attorney is likely to be more lenient if they are assured the full restitution will be made to the victim.
